A Brand New Hospital, a Government ER, and an NCI Cancer Center All Within Three Miles of Each Other — Each One Governed by Different Rules

Doral’s medical landscape changed permanently in 2022 when Baptist Health opened a full service hospital at 9500 NW 58th Street, giving the city its first private acute care facility. Before that, Doral residents were funneled almost exclusively to Jackson West Medical Center, a Public Health Trust facility where sovereign immunity caps your recovery. Today, a Doral resident who dials 911 may be transported to Baptist Health Doral (private, uncapped), Jackson West (government, capped at $200,000 per claimant under current law), or treated at a UHealth urgent care facility that is part of the University of Miami system (private, uncapped despite the Jackson branding in its name). Which ambulance bay you arrive at determines the legal framework that governs your entire case.

⚠ Is Your Deadline Approaching?

Florida law gives you two years from the date you discovered your injury to file a medical malpractice claim, but the mandatory 90 day presuit investigation must be completed first.

WHICH DORAL ER YOU ARRIVE AT DETERMINES THE RULES OF YOUR CASE

Doral has three emergency departments within its borders, each operated by a different entity under a different legal framework. The distinction between them is not academic. It determines whether your damages are capped, what notice requirements you must satisfy, and the maximum compensation a jury can award.

Baptist Health Hospital Doral: Private, Opened 2022, No Cap

Baptist Health Hospital at 9500 NW 58th Street opened in 2022 as Doral’s first private acute care hospital. Its ER alone has nearly 2,800 patient reviews. As a private non-profit Baptist Health facility, sovereign immunity does not apply and jury verdicts are uncapped. We investigate ER misdiagnosis and triage failures, surgical negligence, obstetric and birth injuries, and post operative complications. Because this is a new facility, its internal protocols, staffing ratios, and credentialing practices are still maturing, creating the kind of institutional vulnerabilities that experienced defense counsel will try to minimize and that we are trained to expose.

Jackson West Medical Center: Government Entity, Damage Cap

Jackson West Medical Center at 2801 NW 79th Avenue is a division of the Miami-Dade County Public Health Trust. Sovereign immunity under § 768.28 currently caps damages at $200,000 per claimant and $300,000 per incident. HB 145 (2026), which has passed both chambers and is awaiting the Governor’s signature, would raise these caps to $350,000 per claimant and $500,000 per incident. Its ER carries a 3.2 star rating. A mandatory Notice of Claim to the Florida Department of Financial Services must be filed before the Chapter 766 presuit process can begin. UHealth Jackson Urgent Care at 7400 NW 104th Avenue is also part of the Jackson system and subject to the same cap, despite the “UHealth” branding in its name. Do not confuse this facility with the private UHealth practices on NW 53rd Street, which are University of Miami entities with no cap.

HCA Florida Doral Emergency: Freestanding ER, Transfer Risk

HCA Florida Doral Emergency at 10915 NW 41st Street is a freestanding emergency room, not a full service hospital. It is a private HCA corporate facility with no damage cap. We investigate diagnostic failures, premature discharge, and transfer negligence. A freestanding ER cannot perform surgery, deliver babies, or admit patients to an ICU. When a patient presents with a condition that requires hospitalization and the freestanding ER delays the transfer decision, the time lost during that delay can be the difference between recovery and permanent injury.

SYLVESTER CANCER CENTER DORAL AND THE NW 53RD STREET MEDICAL CLUSTER

The NW 53rd Street corridor between NW 82nd Avenue and NW 87th Avenue is Doral’s emerging specialty medical hub, anchored by the University of Miami. Sylvester Comprehensive Cancer Center operates an NCI designated outpatient oncology facility at 8375 NW 53rd Terrace. UHealth Doral Medical Center at 8333 NW 53rd Street provides multi-specialty outpatient care. Both are private University of Miami facilities with no sovereign immunity cap.

Delayed Cancer Diagnosis at Sylvester Doral

We investigate chemotherapy dosing errors, radiation therapy errors, misinterpretation of pathology results, and delayed cancer diagnosis where a treatable malignancy was allowed to progress to an advanced stage. In lost chance of survival cases, we retain oncology experts who quantify the reduction in survival probability caused by the delay. When an oncologist at the Doral Sylvester outpatient facility fails to escalate abnormal lab results or delays a biopsy, the EMR audit trail proves the timeline of every order, every result, and every missed follow up.

BIRTH INJURY, IMAGING ERRORS, AND HIGH VOLUME URGENT CARE CLAIMS IN DORAL

Birth Injuries at Baptist Health Doral and Doral OB/GYN Practices

Baptist Health Doral is now the primary delivery hospital for Doral families. Multiple independently sueable OB/GYN practices along NW 82nd Avenue and NW 97th Avenue, including Doral Beach Gynecology and West Kendall OBGYN, manage high risk pregnancies and deliver at Baptist Health Doral. We investigate HIE from delayed cesarean sections, failure to respond to Category III fetal heart tracings, and improper use of forceps or vacuum extraction. Because Baptist Health Doral opened in 2022, its labor and delivery unit’s track record is still developing, making early pattern identification and aggressive evidence preservation critical. The statute of limitations for birth injuries is tolled until the child’s eighth birthday.

Diagnostic Imaging Errors: Baptist Health and Vital Imaging

Baptist Health Diagnostic Imaging at 9915 NW 41st Street has over 3,100 patient reviews, making it the highest volume imaging center in Doral. A second Baptist imaging location operates at 8400 NW 53rd Street in Downtown Doral. Vital Imaging Center at 3155 NW 82nd Avenue handles nearly 1,500 reviews worth of PET/CT and MRI studies. Life Radiology at 3470 NW 82nd Avenue carries a 2.5 star rating. A misread MRI or CT that fails to identify a tumor, fracture, or vascular abnormality is a diagnostic failure that can result in delayed cancer treatment and catastrophic outcomes. The radiologist who misread the study and the corporate entity that employs them both bear liability.

Urgent Care Misdiagnosis: The Highest Volume in Miami-Dade

Baptist Health Urgent Care at 9915 NW 41st Street has nearly 5,800 patient reviews, making it one of the highest volume urgent care facilities in all of Miami-Dade County. A second Baptist Health Urgent Care operates in Downtown Doral at 8400 NW 53rd Street with over 1,400 reviews. Sanitas Medical Center at 2000 NW 87th Avenue has over 3,600 reviews. At this volume, time sensitive conditions are routinely evaluated and sometimes missed. We investigate strokes dismissed as vertigo, cardiac events dismissed as indigestion, fractures misread on X-ray, and infections sent home without appropriate follow up. The EMR proves what was documented and what was overlooked.

Three ERs. Three Legal Frameworks. The Wrong Filing Costs You Everything.

Baptist Health Doral is uncapped. Jackson West is capped under sovereign immunity. HCA Doral Emergency is a freestanding ER with transfer risk. We file correctly from day one.

FREQUENTLY ASKED QUESTIONS

Is Jackson West Medical Center a government hospital?+

Yes. Jackson West at 2801 NW 79th Avenue is a division of the Miami-Dade County Public Health Trust. Sovereign immunity under § 768.28 currently caps damages at $200,000 per claimant and $300,000 per incident. HB 145 (2026), awaiting the Governor’s signature, would raise these to $350,000/$500,000. A mandatory Notice of Claim to the Department of Financial Services must be filed before the presuit process can begin.

Is UHealth Jackson Urgent Care in Doral part of the Jackson system or the University of Miami?+

UHealth Jackson Urgent Care at 7400 NW 104th Avenue is part of the Jackson Health System and subject to the sovereign immunity cap. Do not confuse this facility with UHealth Doral Medical Center on NW 53rd Street, which is a private University of Miami facility with no cap. The branding overlap between “UHealth” and “Jackson” creates genuine confusion that can destroy a claim if the wrong entity is named at the outset.

Is Baptist Health Hospital Doral too new to sue?+

No. Baptist Health Hospital Doral opened in 2022 and is a fully licensed private hospital. It is subject to the same Florida malpractice laws as any other hospital. The fact that it is new does not provide any legal immunity. In fact, new facilities may face heightened scrutiny regarding staffing adequacy, credentialing practices, and the maturity of their internal safety protocols.

What is a freestanding ER and why does it matter for my claim?+

HCA Florida Doral Emergency at 10915 NW 41st Street is a freestanding ER, meaning it operates independently and is not attached to a hospital. It cannot perform surgery, admit patients, or provide ICU care. When a patient presents with a condition requiring hospitalization and the freestanding ER delays the transfer to a full service hospital, the time lost during that delay can cause irreversible harm. Transfer negligence at freestanding ERs is a distinct category of malpractice claim.

Can I sue for a delayed cancer diagnosis at Sylvester in Doral?+

Yes. Sylvester Comprehensive Cancer Center on NW 53rd Terrace in Doral is a private University of Miami facility. Sovereign immunity does not apply. If a delayed diagnosis allowed a treatable cancer to progress, Florida law permits a claim under the lost chance of survival doctrine.

What does it cost to hire a medical malpractice lawyer for a Doral case?+

We operate on a contingency fee basis. We advance all costs of the forensic investigation, medical record retrieval, and expert retention. You pay nothing unless we recover compensation on your behalf.
